TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of the services provided by In GUUD Company (“In GUUD Company,” “we,” “our,” or “us”). By engaging our services, submitting an inquiry, or making any payment, you agree to be bound by these Terms.
1. Scope of Services
In GUUD Company provides animal travel coordination and escort services, including itinerary planning, airline and private aviation coordination, documentation assistance, and airport pickup and drop-off services. We act solely as a concierge and facilitator, coordinating with independent third-party service providers such as airlines, private charter operators, veterinarians, and ground transport companies.In GUUD Company is not an air carrier, freight forwarder, or veterinary provider. We do not operate aircraft and do not provide medical, veterinary, quarantine, or training services.
Where applicable, services are coordinated in accordance with airline policies and applicable USDA Class H licensing requirements.
2. Client Responsibilities
Clients are solely responsible for:
- Providing accurate, complete, and timely information regarding animal(s) and owner(s)
- Ensuring compliance with all airline, destination, import, and export requirements
- Obtaining required veterinary documentation unless otherwise agreed in writing
- Maintaining timely communication throughout the planning and transport process
Failure to provide accurate or timely information may result in delays, additional costs, denied transport, or cancellation without refund.
3. Third-Party Providers
In GUUD Company coordinates services performed by independent third-party providers, including but not limited to airlines, private charter operators, veterinarians, and ground transportation providers. These parties are not employees, agents, partners, or joint venturers of In GUUD Company.
We do not control and are not responsible or liable for the acts, omissions, delays, cancellations, decisions, or failures of any third-party provider.
4. Escort Services & Assumption of Risk
Where agreed in writing, In GUUD Company may personally escort animals during air travel. Escort services are limited to airline-approved handling, including check-in, security, boarding, arrival, and handoff, and do not include medical, behavioral, or training services.
Client acknowledges that animal air travel involves inherent risks, including stress, illness, injury, delay, or denial of transport. To the maximum extent permitted by law, Client assumes all such risks, except in cases of gross negligence or willful misconduct by In GUUD Company.
5. Payments, Deposits, and Fees
- A non-refundable deposit is required to initiate planning and coordination services.
- The deposit compensates In GUUD Company for time, planning, coordination, and administrative services that commence immediately upon receipt.
- To the maximum extent permitted by law, deposits are non-refundable once services have begun.
- The remaining balance is due prior to ticketing or final confirmation.
- Payments made beyond the deposit may be considered for refund on a case-by-case basis, determined in good faith at the sole discretion of In GUUD Company, and only to the extent that third-party costs have not been incurred.
- Airline fees, charter costs, veterinary fees, documentation fees, and other third-party charges are non-refundable once incurred.
Client authorizes In GUUD Company to remit payments to third-party providers on Client’s behalf.
6. Cancellations and Changes
Client-requested changes after planning has begun may result in additional fees. Cancellations do not entitle Client to a refund of any payments made, except as expressly provided in Section 5 and to the extent permitted by law.
7. No Guarantees
In GUUD Company does not guarantee:
- Airline, customs, or government approval
- Specific travel dates, times, routes, or carriers
- Successful transport outcomes
All such decisions are made by third parties or government authorities outside our control.
8. Force Majeure
In GUUD Company shall not be liable for failure or delay due to events beyond reasonable control, including but not limited to weather, natural disasters, pandemics, strikes, labor disputes, government actions, airline cancellations, border closures, or acts of God.
9. Limitation of Liability
To the maximum extent permitted by law, In GUUD Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages. In no event shall our total liability exceed the fees paid to In GUUD Company for the specific services giving rise to the claim, except where prohibited by law.
10. Dispute Resolution
Any dispute arising out of or relating to these Terms or the services provided shall first be submitted to good faith mediation in the Commonwealth of Virginia. If mediation is unsuccessful, the dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.
Judgment on the arbitration award may be entered in any court of competent jurisdiction.
11. Governing Law & Venue
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Exclusive venue for any permitted court proceedings shall be state or federal courts located within the Commonwealth of Virginia.
